Do Not Ring Your Motor Vehicle Insurance Company Following YourTraffic Accident:
Please read this advice carefully as it will save you money and ensure that you obtain full consumer value from your claim.
When you purchased your motor vehicle insurance your insurance brokers who could well be a motoring organisation inevitably added a legal expense insurance policy within your cover. Sometimes this is added free (and you then have to question you have obtained any value at all) but as often as not a broker will add a fee of between £15-£25 to cover legal expenses should you have an accident.
Do you actually know what this means?
In our experience, legal expense insurance does not actually exist. There is not normally a policy issued, no cover note supplied and no policy terms and conditions. No insurance premium tax is paid upon it and it cannot therefore as a matter of law be classed as legal expense insurance. All it is, is a scam to allow such insurers direct access to your claim and almost oblige you to use their panel of solicitors.
Paul Asplin who is the Chief Executive Officer of DAS one of the largest legal expense insurers in the country (having approximately 20% of the market share) is on record as saying that the only income his company receive is the referral fee charged to solicitors when referring the claim on. This means that the money for selling the policy in the first place is retained by the broker as a windfall and that comes directly from your pocket. When you are then unfortunate enough to have an accident and require legal representation the legal expense insurers will then sell your claim to the solicitors for a referral fee that we now have on good authority has approached £825.
This money is therefore taken directly from the money then available for your legal spend which on average will be in the region of £1200. Obviously this can leave as little as £375 for the solicitor to fight your case. The legal expense insurance companies recognise that this is the only income they receive. This means that money from your case is taken from your legal spend and is then applied to their profit. For this you receive no conceivable consumer value for a road traffic accident claim falling within the predictive costs regime.
This trade in personal injury cases allows these insurers to reap £370M a year. We believe that this money is taken directly from consumers and must be given back. It is for that reason that we repeat the advice DO NOT RING YOUR INSURERS FIRST FOLLOWING A ROAD TRAFFIC ACCIDENT RING A SOLICITOR.
This evil trade in personal injury cases and referral fees being charged by motoring organisations, car repair garages, motor vehicle insurers and other referrers has been recognised by the Lord Chancellor Lord Falconer. He is now on record as stating his intention to remove referral fees from personal injury having recognised the effect that this has on public perception and upon consumer value. We at RTA110 applaud his comments and we hope that our scheme devised and implemented by solicitors will help solicitors to recover the market from interfering middle men who have no place within it.
Mark Lampkin, the solicitor who invented the scheme now regularly appears on motoring websites, publications and in other press material. Examples of our press coverage can be found on our news page and we are hoping that as more solicitors offer a similar service the public will become aware of the benefits of seeing a solicitor should they be unfortunate enough to have a motorcycle accident or car accident leading to a compensation claim for injuries.

Any insurers, motoring organisations, garages, repairers or other referrers of car crash or motorcycle accident claims should contact us through the site and to establish links with us. For our part we confirm that we will seek to deal with such ethical and like minded suppliers to the industry and we will not seek from them referral fees just as we will not pay referral fees to them in the first place.
All staff dealing with automobile accidents of any nature are fully trained. We have specialist departments dealing with motorcycle accidents where it is an obligation for staff to have secured a full bike licence in order to appreciate accidents from the circumstances of the rider.
